How long does an antidumping investigation last in Argentina?
The standard duration is 12 months from the opening of the investigation, extendable by an additional 6 months in complex cases. However, provisional measures may be applied from around month 6, making active participation from the outset essential.
Can an importer continue importing during an antidumping investigation?
Yes, but with guarantees. Once the CNCE recommends provisional measures, imports must be secured through a deposit or bond equivalent to the estimated provisional duty. Monitoring the case and challenging the estimated margins can significantly reduce this
Can an established antidumping duty be challenged?
Sí. Los Definitive antidumping duties have a maximum duration of 5 years, after which an expiry review may be requested. During this period, annual reviews may also be requested if market conditions have changed. We advise on both procedures.
